  1. Welcome to the website https://kids360.app, the company’s official social media pages, and the mobile apps “Kids360” and “Alli360” (hereinafter referred to as the “Service”) provided by Anko Solutions LLC. (hereinafter referred to as the “Company” or “We”).

1.1 This document describes the terms and conditions under which you may use the Service. By accessing or using the Service, you acknowledge that you have read, understood, and agree to comply with these Terms of Service (hereinafter referred to as the “Terms”). They apply to all visitors, users, and other individuals who use the Service (“Users”).

1.2 These Terms constitute a public offer, i.e., a proposal to enter into a License Agreement for the right to access and use the Service.

1.3 If you do not agree to these Terms, do not click the “Get Started” button and do not use the Service. If you click the “Continue” button, you are deemed to have agreed to all provisions of these Terms and Conditions without exception (your acceptance is full and unconditional) and to have entered into a License Agreement with us under the terms of this offer.

2. Use of the Service

2.1 The Service is designed to give parents peace of mind regarding their children.

2.2 A Child is a person under the legal age at the time of installing and using the “Kids360” mobile application. Children are prohibited from creating an account on the Service.

2.3 A Parent is a person who is of a legal age and has installed the “Kids360” mobile app to communicate with a Child who has been added to their account.

2.4 You may use the Service only in accordance with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

2.5 The Service is intended for residents of the United States and European Union countries; certain features of the Service may not function in areas outside the coverage area of GPS and the wireless data network for the phone on which the mobile software is installed.

3. Information required to install the software.

3.1 Install the “Kids360” app on the Parent’s phone.

3.2 From the “Kids360” app, send a link or use an access code to install the “Alli360” app on the Child’s phone.

3.3 Follow the link and install the “Alli360” app on the child’s phone.

3.4 After installation via the link or by entering the access code, the child will automatically be connected to the Parent.

3.5 If this does not happen, use the pairing code found in the Parent’s app.

3.6 Configure the necessary settings on the child’s phone.

4. Terms of the Service Usage

4.1 License. Subject to the Terms, the User is granted a non-exclusive, non-transferable, revocable license to use the Service solely for personal, non-commercial purposes and in accordance with the Service’s capabilities. The Company may terminate this license at any time.

4.1.1 Accounts created when using the Service provide you with access to services and features that We may expand and maintain at our sole discretion.

4.1.2 When creating your account, you must provide accurate and complete information. You are solely responsible for the activities that occur under your account, and you must keep your account access secure.

4.1.3 You must notify us immediately of any security breach or unauthorized use of your account.

4.1.4 The Company is not liable for any losses resulting from any unauthorized use of your account.

4.1.5 You can manage your user profile and how you interact with the Service by changing the settings available to you.

4.1.6 To use the “Kids360” and “Alli360” apps, your mobile device must be compatible with them. The Company cannot guarantee this.

4.2 The user may not:

  • copy, distribute, or disclose any part of the Service in any medium, including through automatic or non-automatic “reproduction”; 
  • use any automated system, including “bots,” etc., to access the Service in a manner that sends more requests to the Company’s servers than a human could reasonably generate in the same period of time using a standard online web browser; 
  • transmit spam, chain letters, or other unsolicited content;
  • attempt to interfere with the operation of the Service, compromise the integrity or security of the system, or decrypt any data transmitted to or from the servers on which the Service is hosted; 
  • take any action that imposes or may impose, in our sole discretion, an unreasonable or disproportionately large load on our infrastructure; 
  • upload viruses or other malicious software through the Service; 
  • collect any personal information, including the usernames of Service users; 
  • use the Service for commercial purposes; 
  • impersonate another person or otherwise misrepresent information, commit fraud, conceal, or attempt to conceal your identity; 
  • interfere with the proper functioning of the Service;
  • access any content on the Service using any technology or means other than those provided or authorized by the Service; or circumvent measures we may use to prevent or restrict access to the Service, including, without limitation, features that prevent or restrict the use or copying of any content or impose limits on the use of the Service or the content therein.
  • With respect to the “Kids360” and “Alli360” apps, you may not: (i) modify, decompile, or reverse engineer the mobile apps; (ii) sublicense, distribute, or otherwise transfer the Mobile Software to any third party, or use the Mobile Software to provide shared access to any third party; (iii) make any copies of the Mobile Software; (iv) remove, circumvent, disable, damage, or otherwise interfere with the functions of the Mobile Software; or (v) remove copyright notices or other proprietary notices from the Mobile Software.

4.3 App Updates.

4.3.1 The Company may release updated versions of the apps from time to time.

4.3.2 You consent to such automatic updates on your mobile device and agree that the Terms will apply to all such updates. 

4.3.3 Any third-party product that may be included in the apps is distributed under an open-source license or a third-party end-user license agreement, unless otherwise specified in the terms of use for that product.

5. Notifications and Messages

5.1 By providing the Company with your email address and phone number, you agree that We may use your email address or phone number to send you service-related notifications, including any notices, instead of sending a paper-based message via postal mail.

5.2 We may also use your email address to send you other messages, such as changes to the Service’s features and special offers. If you do not wish to receive promotional emails, you may opt out of receiving such emails from the Company. Opting out may prevent you from receiving emails regarding updates, improvements, or offers.

6. Our Intellectual Property Rights

6.1 All materials and information on the Service, or data generated, collected, or transmitted through the use of the Service, including images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, video, music, and User Content, as well as the associated intellectual property rights, are the exclusive property of the Company and its licensors (including Users who post User Content to the Service).

7. Service Features

7.1 The service consists of two interconnected apps: “Kids360,” which is installed on the Parent’s mobile device, and “Alli360,” which is installed on the Child’s mobile device. 

7.2 To activate access to “Alli360,” you must enter the access code sent to the Parent using the “Kids360” Service or follow the link that the Parent can send to the Child.

7.3 The “Kids360” app includes the following features, among others:

  • Automatic blocking of apps when the daily usage time limit set by the Parent is reached on the Child’s device
  • Setting a blocking schedule to restrict access to selected apps during specified time intervals;
  • Determining the location of the Child’s device by displaying its current geolocation on a map within the app in real time;
  • App usage statistics on the Child’s device with the “Alli360” app installed—information presented as: “app name on the Child’s device – time spent using it over a specific period.”

8. Paid Features of the Service

8.1 The Company offers a free trial period for using the Service.

8.2 If you decide to use the paid features of the Service, you agree to the pricing and payment terms.

8.3 All paid subscriptions and fees for access to subscription features are paid in advance (on a prepaid basis).

8.4 The Company is not liable for any additional costs or expenses you may incur as a result of payments charged by the Company in accordance with the Terms (e.g., fees, taxes, and charges, etc.).

8.5 The payment procedure and cost are determined in accordance with the terms of the online platform from which you download the mobile app.

8.6 After initial registration, you may be granted access to paid features for an initial trial period, which may remain active for the duration of use in accordance with the plan selected by the User. The trial period is limited to one user. 

8.7 If you do not cancel your subscription during the trial period, you will be charged based on the plan you selected during registration.

8.8 You can delete or close your account at any time (see the section below). 

8.9 If you wish to change your account type, you can do so at any time (before or after the trial period).

8.11 All information you provide in connection with a purchase, transaction, or other monetary interaction with the Service must be accurate, complete, and current.

9. Closing Your Account and Unsubscribing

9.1 To unsubscribe, please email support@kids360.app.

9.2 In your email, please include your name, the email address you used to register, and a phone number where We can reach you.

9.3 Your request will be processed within 5 business days of receiving confirmation of your cancellation request.

10. Third-Party Links

10.1 The Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by the Company. The Company is not responsible for such third-party sites, or for the information, content, products, or services contained therein. If you access a third-party website from the Service, you do so at your own risk and understand that the Terms do not apply to your use of such websites. You agree that the Company is not liable for any loss or damage arising from your dealings with third-party advertisers.

11. Indemnification and Liability

11.1 You agree to indemnify the Company against any losses arising from your breach of the Terms, including, but not limited to, your breach of any of the representations and warranties set forth herein; your infringement of any third-party rights, including, without limitation, the right to privacy or intellectual property rights; your violation of any applicable law, rule, or regulation; and any other party’s access to and use of the Service using your unique username, password, or other applicable security code.

11.2 Unless otherwise specified, all materials contained in the Service are intended exclusively for individuals.

11.3 The Service is provided by the Company “as is.” The Company does not guarantee that the Service will meet the Users’ objectives and expectations, or that the Service will operate without interruption or error. The Company shall not be liable for and shall not compensate for any damages, whether direct or indirect, caused to the Service User or third parties as a result of the use or inability to use the Service.

11.4 The User is solely responsible to third parties for their actions while using the Service, including ensuring that such actions comply with legal requirements and do not infringe upon the rights and legitimate interests of third parties. 

11.5 The User undertakes, at their own expense, to resolve all claims by third parties arising from the User’s actions while using the Service.

11.6 The Company is also not responsible for the gadget loss.

11.7 Attention, dear residents of California! You are entitled to the following specific consumer rights information: You may contact the Complaint Assistance Unit of the Division of Consumer Services of the Department of Consumer Affairs by mail at 400 R St., Suite 1080, Sacramento, California,95814, or by telephone at 916.445.1254.

California residents expressly agree to waive California Civil Code Sec. 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

11.8 European Union residents should be aware that our Service is the exception to the right of withdrawal from the contract stipulated in Article 16 (m) of Directive 2011/83 / EU of 25 October 2011. This is due to the fact that the Contract between You and Us comprises the supply of digital content which is not supplied on a tangible medium the performance has and this Contract has commenced with Your prior express consent.

This means that once You have paid for the Subscription, You lose the right to terminate the contract and refund the amount paid for it.

12. General Provisions

12.1 These Terms are governed by the laws of the UAE, Dubai.

12.2 Any rights and licenses granted under these Terms may not be transferred by you to any third party. Any attempt to transfer or assign rights in violation of this document is void.

12.3 The Company reserves the right to determine the form and means of providing notices to our users.

12.4 The Company may, at its sole discretion, modify these Terms from time to time, and therefore you should review this page periodically.

12.5 If We make changes to the Terms, We will update the last modified date on this page. Your continued use of the Service following any such change constitutes your acceptance of the new Terms of Use.

12.6 These Terms, together with any amendments and any additional agreements you may enter into with the Company in connection with the Service, constitute the entire agreement between you and the Company regarding the Service. 

12.7 If any provision of the Terms is held to be invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms, which shall remain in full force and effect.

13. Prohibition of Child Sexual Abuse and Exploitation

13.1 Our Service is operated in compliance with applicable laws, including those related to child safety. We condemn child sexual abuse and exploitation and prohibit the use of the Services for these purposes.

13.2 If you believe that the Services are being used in violation of this prohibition, please contact us via email at report@kids360.app. We will immediately investigate your complaint and respond to any additional questions you may have regarding our methods for preventing child sexual abuse and exploitation content.

13.3 We will immediately remove content related to child sexual abuse and exploitation, notify the reporter, and reserve the right to suspend the account of the User who violated the prohibition and report all information We have regarding such an incident to law enforcement authorities.
